PREAMBLE:
The order for the products presented in the electronic catalogue of this website is subject to acceptance by the purchaser, and constitutes the acceptance, without any reservation by the latter, of all the general conditions of sale (GCS) set out below. These Terms and Conditions are binding on the buyer regardless of any specific clauses added by him - unless expressly agreed by the seller - and without regard to advertising documents issued by the website owner. The buyer's acceptance is materialized by their electronic signature, materialized by the "validation click". This electronic signature is equivalent to a handwritten signature between the parties. This is equivalent to acknowledging that the buyer has fully read and agrees to all of the conditions set out below. Except in the cases exhaustively provided for in these Terms and Conditions, the purchase order electronically signed by the buyer, by means of the "validation click", is equivalent to a final order and cannot be withdrawn. Under these conditions, we invite customers who have connected to the electronic distance selling catalogue to read the following general terms and conditions of sale carefully before placing any actual order for products included in this catalogue. Orders placed on the server and on a purchase order are binding on the customer as soon as our customer service department receives the order and its payment. In the case of cash on delivery, orders placed on the server by purchase order are binding on the customer as soon as the order is received by our customer service.
Article 1: PURPOSE
These General Terms and Conditions of Sale (GTCS) are intended to specify the rights and obligations of the buyer in relation to the products sold in our electronic catalogue within the framework of a distance selling system. The contract concluded in the event of an actual order, within the scope and under the conditions provided for in these GTCS, is subject to the rules on distance selling, which result, in particular, from the Consumer Code, as well as to the specific provisions referred to below. Article 3: ESSENTIAL CHARACTERISTICS OF THE GOODS AND SERVICES
OFFERED The products offered in the e-catalogue and whose distance selling is governed by these General Terms and Conditions of Sale have the following essential characteristics:• Products concerned: the name, packaging, quantity and special features are specified for each of the products in the e-catalogue. All these elements are included when the order is placed by the buyer. Photographs presenting the products offered in the e-catalogue are not contractual and cannot give rise to the seller's liability to the buyer.• Geographical area of delivery: the offer referred to in these T&Cs is limited to the same area.• Availability of the goods or services: the products presented in the e-catalogue and the distance selling of which is governed by these T&Cs are available for as long as the product in question appears in the e-catalogue, as long as the manufacturer lasts.
Article 4: DURATION OF THE OFFER
The offers for sale contained in the electronic catalogue, governed by these general terms and conditions of sale, are valid for any product contained in this catalogue for as long as it remains online or while stocks last.
Article 5: PRICES
The price is indicated for each of the products listed in the electronic catalog. The price does not include taxes and is fixed on the date of acceptance in euros, article 6 below. The price guaranteed to the buyer shall be the price indicated in the electronic catalogue in euro or in the written offer at the time of purchase, which shall take place on the acceptance of the offer by the buyer under the conditions referred to in Article 6 below. The price must be paid in full before delivery. The seller reserves the right to modify the sales prices that appear in its catalog at any time. The rate in parentheses and is indicative.
Article 6: ACCEPTANCE OF THE OFFER
The acceptance of the offer by the purchaser takes the form of validation, within the scope of the electronic catalogue, by a "validation click", or by his signature. All information must be filled in by the buyer: Surname, first name, delivery address, e-mail. The order placed by the buyer is subject to written confirmation by e-mail from the seller. This confirmation contains: product description, order quantity, price, VAT (if applicable) as well as delivery terms. (Unless sent by purchase order signature)
Article 7: PAYMENT:
The buyer must pay by one of the payment methods offered on the website for the full payment of their order triggering the delivery of their order. The buyer guarantees the seller, when validating his purchase order, that he is in a legal situation vis-à-vis the payment card issuer. The customer undertakes to pay the sales price in force at the time of placing the order. Payment of the order is paid before delivery, payment by bank transfer is possible within 3 days, after this period, the order is canceled, or by credit card, according to your choice, except for the purchase of equipment directly or cash on delivery.
Article 8: DELIVERY
The ordered product(s) are delivered by a carrier to the address indicated in the buyer's order. In the event that the buyer is absent when the product ordered in the e-catalogue is delivered, it is the buyer's responsibility to contact the carrier to arrange a new delivery or pick up the order from the warehouse. In the event of non-conformity of the delivered product with the indications given on the purchase order or transport-related damage observed at the time of delivery, the seller undertakes to remedy this. The delivery time is indicated on the website. The deadline is indicative and the seller cannot be held liable if this deadline is exceeded. In particular, the exceeding of this indicative period, in particular for reasons of force majeure such as strikes or bad weather preventing deliveries, cannot justify the cancellation of the order, any reduction in the price paid by the buyer and any payment of compensation. Mediatec undertakes to make every effort to deliver the order as soon as possible, as soon as the order form is received. The customer makes the arrangements, rights and acceptance in accordance with the code and legal provisions for its installation. The delivery times indicated on the order form are indicated as an indication and any delays do not entitle the buyer to cancel the sale, refuse the goods or claim compensation. Any claim for non-conformity or lack must be sent within 3 days from the date of receipt of the order by registered mail. Mediatec is exempt from its obligation to deliver in the event of unforeseeable circumstances or force majeure. By way of indication, total or partial strikes, floods and fires are cases of force majeure. The transfer of ownership of the delivered or to-be delivered products is suspended until the customer has paid the price in full, without affecting the transfer of risk. Mediatec may charge a fee for any refusal to deliver or cancel an order. Shipments are covered by the Terms and Conditions of the Portuguese postal service providers. Other shipping service can be requested in writing, the additional cost is to be borne by the customer. Orders to PORTUGAL are sent free of charge by the carrier CTT (Portuguese postal service) in normal delivery, i.e. without signature or tracking of the order. MEDIATEC is therefore not responsible for any loss or delay in delivery, as it is impossible for MEDIATEC to track the order by this delivery method. When ordering from Portugal, the customer may choose to have the order delivered with signature, subject to payment of additional shipping costs, in which case MEDIATEC can give the customer the delivery number and it is the customer's responsibility to check with the carrier the status of the order. MEDIATEC cannot be held responsible for the delay or loss of the parcel after it has been picked up by the carrier.
Article 9: PERSONAL INFORMATION
In the absence of an express objection on your part, the buyer gives his consent to the use of the personal data collected pursuant to his order in the seller's customer file. The buyer has the right to access and rectify the data at any time.
Article 10: APPLICABLE LOCATION
This agreement is subject to the Code of Obligations and may be modified at any time.
Article 11: RIGHT OF WITHDRAWAL
You have a withdrawal period of 14 days from the receipt of your order to return the product that does not suit you, that is defective or that does not conform to the order. The products must then be returned according to our return procedure, in their entirety, intact, in perfect working order and in their original packaging. The right of withdrawal takes effect on the day following the receipt of the goods at the address indicated by the customer. The latter will then bear the costs of the retransfer. Any refurbishment costs will be charged to the customer. For any return of items on sale within the 14-day resolution period, you can choose to create a credit note valid for 1 month or exchange it for another item in the store.
Article 12: DISPUTE RESOLUTION In
the event of a disagreement or dispute, the buyer must first approach the seller with the aim of resolving the problem amicably. If the Seller does not require the fulfilment of an obligation that the Buyer is required to fulfil under these GTCS, this does not mean that the Seller waives its right to demand the fulfilment of this obligation at a later date. In other words, the seller's silence in the face of a default by the buyer is not a waiver of its right to require the buyer to perform its obligation in the future.
Signing the document, settling the transaction, or clicking validation (most likely on a website or app) means that you, as a buyer, accept all the conditions set out in the Terms and Conditions."

Article 13: Right of return
You have a right of return of 14 days after the date of receipt for products purchased online or in-store. This period allows you to make an informed decision about your purchase.
*Exceptions to the right of recourseThere are some exceptions to this right of recourse. We will not be able to accept returns in the following cases: :*if the goods have suffered damage other than that due to shipping. We agree to take into account any damages incurred during transit, provided that you have notified us immediately upon receipt.*Returned products will only be accepted if they are in perfect condition. This means that they must be intact, unused, unopened and returned in their original intact packaging.
RefundWe will only process the refund if the returned item is still in its original packaging, unopened and undamaged. The refund will be made in full, in the form of a credit note, equivalent to the purchase price of the good.
Return shipping costsPlease note that shipping costs for returning items are usually the responsibility of the sender. However, if you prefer, you can bring the item directly to our center located at 3720-006 Baralhas-Ossela. In this case, don't forget to bring your purchase invoice, as it will be needed for the return process.

Article 14: Exclusion of Warranty for Accessories.
- Scope of Warranty: The warranty offered by MEDIATEC is limited to the main device of the device purchased. Accessories, such as remote control, power supply, other accessories, included with the box or purchased separately, are not covered by this warranty.
- Notification of Defect and Return Procedure: In case of defect of accessories, the customer must inform our company within 14 days of purchase, sending the defective parts with the description of the defect. The return costs will be borne by our company, as long as the shipment is carried out in accordance with our guidelines. Parts must be properly packaged for transport. Failure to comply with this procedure voids any right to complain about the accessories.
- Limitations: Claims for material defects will not be accepted beyond 14 days after purchase. The warranty excludes damage due to misuse, improper maintenance, accidents, or unauthorized modifications or repairs.
